- SERVICE RENDERED – LIABILITY CLAUSE
The Company accepts zero responsibility for any loss or damages allegedly incurred as a result of engaging with service provision, resources, or writings, some of which have been designed specifically to uncover the parts of yourself that are difficult to see/deal with. Please refer to the Health and Safety page for a wider view of how important this is for the consumer to understand and take responsibility of. This is a part of the package and the Consumer is responsible for their own wellbeing and for protecting themselves from harmful engagement. They may ask for help, but the Company is neither liable nor responsible for your world and life as it is, or any impact of the work YOU CHOOSE to engage with, under full awareness of your autonomy and the responsibility you have to yourself. All services are provided as outlined, and the author, publisher and third parties deliver products, services, and free resources, with the understanding that all parties are not engaged in rendering psychological, financial, legal, or other professional aid.
Please note: timing is everything and when things get too much we suggest taking some time to rest and recover before re-engaging with your journey of healing and recovery, if this is the road you are on. Everything is designed with the intent to delve deeper and/or support recovery efforts from conditions such as depression, anxiety trauma and possibly other complex ailments. However, this is not a medical treatment platform, and the ‘self-help’ nature of the service enforces that YOU are responsible for self-monitoring any risk of decline, as well as for the accessing of your own treatments and therapies, at 100% your own expense. Thus, it is important that the responsible consumer partakes in therapy and seeks their own medical treatment pathway when required, as well as other avenues of societal support if and when needed.

- UK – DATA PROTECTION ACT 2021 UPDATED VERSION (POST-BREXIT)
As required by The Data Protection Act (2021), this Privacy Policy identifies the categories of personally identifiable information that we collect through our website about individual consumers who use or visit our website and the categories of third-party persons or entities with whom such personally identifiable information may be shared.
Depending on the visitor’s activity at our website, certain “data protection principles” (as that term is defined in The Data Protection Act) may be respectfully adhered to, in addition to information set forth in other sections of this document. For purposes of the Data Protection Act, the term “data protection principles” ensures the following;
That all data is:
- used fairly, lawfully and transparently.
- used for specified, explicit purposes.
- used in a way that is adequate, relevant and limited to only what is necessary.
- accurate and, where necessary, kept up to date.
- kept for no longer than is necessary.
- handled in a way that ensures appropriate security, including protection against unlawful or unauthorised processing, access, loss, destruction or damage.
Any information collected from an individual may include the following, as requested by online forms: (1) a first and last name; (2) a home or other physical address, including street name and name of a city or town; (3) an email address; (4) a telephone number; (5) any other identifier that permits the physical or online contacting of a specific individual; and (6) information concerning a user that the web site collects online from the use, and maintains in personally identifiable form, in combination with an identifier described within this Privacy Policy.
Full Disclosure Agreement – Amendment to Data Release for Specificity:
Any information shared in correspondence with The Company, be that in audio format, visual, text, or other, will become the property of The Company, and can be used for publishing, or other unspecified purposes once the time-lapse period has expired, for example: artistic creation, film media, documentary and other similar creative mediums. It is maintained herein that The Company, the author, publisher, or other third parties, are not liable nor responsible for any loss, damages or injury, allegedly resulting from any engagement with this platform or related publications and research. Specifically, for each correspondence channel, we make things 100% clear below:
Ask A Question – When you submit a question you give The Company permission to publish that question and the related answer to anamaria.org with immediacy, as well as in print or for use with other mediums, including art. You can opt to keep the question from the blog by copying and pasting the following phrase into your submission form: *I would rather my question remain private and not be posted anonymously to the blog. Thank you. However, take note that after 5 years that declaration becomes null and void, and your question can be posted in total anonymity to anamaria.org, as well as it becoming free to print in text, ebook, audio format, and other visual mediums (see paragraph directly above).
Quotes can be used, your stories retold and used especially for teaching purposes, and the aim of it all is to expand your lesson/ line of inquiry into a wider lesson that can have greater impact and serve/ benefit the public. Should you disagree with any future publishing uses, please use another service, as there can be no retrospective changing of one’s mind. Once your question is submitted, your correspondence can either be posted with immediacy to this platform, or used for other purposes after 5 years, and any question submission must be submitted in full awareness of that being the case. If you do not declare immediate non-disclosure preference, your submission is available to The Company to use as they wish, within predictable reason.
Pen-Pal Service – When you correspond with Ana Maria by using the Pen-Pal Service (or any other service), every single correspondence is stored both online under the email server, as well as offline, all communications being collected for research and publication purposes. Although anonymity is 100% maintained, you do permit, by commencing your engagement with the service, to all information disclosed being used in later publications and/or in various creative mediums, and for all other relevant research purposes. However, please rest safe in the knowing that your anonymous information cannot be published in its entirety until the year 2040, by which time the delicate nature of such an event impacting your sense of safety should be predictably minimised. Know that all locations, names, and even familial/ relational details will be omitted or changed entirely for public safety. You are permitting these publications and research projects by engaging from your first submission here.
Please note, from the date of your submission, should a caption, phrase or general inquiry route produce creative inspiration, that section of your submission may be quoted directly, with changes to place, people, and theme, all to protect your anonymity and preserve safety, especially when your story presents as high-risk in terms of exposure to an external person of threat. We do know that people need to stay safe and we align with that need. The reason for this ‘quoting’ clause and option, is to ensure that your work with The Company can simply be used to aid other people in need, and where this is the case, you automatically permit the ‘helping of you’ to be transformed into a format that may help another in a similar situation/ living a similar thread of story in life.
We are in this together, and you will always be informed of such an instance so as to ensure there are no ‘surprise reactions’ you have to live through. When we do inform you via the given email address, you will have 10 consecutive days to respond; although by engaging you cannot stop the use of anything you have written to The Company, at The Company’s discretion, we may mediate to a comfortable outcome for both parties, should you not want to have your words used in any way. For specificity in regard to volume of ‘data’ available for use by The Company, only 1 email submission, out of context, can be utilised per month. In other words, should you write 10 emails to The Company within 30 days, and one can be used to illustrate to others how to survive something, or do something in a new way, you will be informed beforehand, invited to welcome the experience, or not, and things will be taken from there. To confirm, we cannot use an entire month’s dialogue to help others, only an example from a single email address. This way, we do hope to minimise risk of exposure and any anxiety on the part of The Client. Further to that, generally speaking, if a person really hates the idea of it all, although our right to do so, we are likely to respect the needs of the client over the needs of The Company and cease with present usage, perhaps pegging it for a later date.
Confessions – Because of the nature of the service and the risk to the individual should their confession go public, even anonymously, there is a 50 year non-disclosure clause, which begins automatically from the time and date of your submission. In other words, submit your confession on 3rd April 2023, it cannot be published in full until 4th April 2073. This protects those confessing from exposing themselves in a way that feels unsafe or uncomfortable. Please note, if Ana Maria Santuario dies, this service is likely to continue, and it must be understood that when one ‘confesses’, they confess to The Company, and not Ana Maria Santuario (although, while alive, she will be the one to read them, after that, we have yet to determine the trajectory ahead, which must be known by the writer). They must also comprehend, that no matter what, this confession does still become the property of The Company, and it will be potentially published partially in print, used in video work, audio, research and documentary series before the 50 year marker, yet the confession in its entirety will not be published until those 50 years have been marked and confirmed.
Advocacy and Social Wellbeing Projects – This is a qualitative data collection area of the two working bodies, The Ana Maria Foundation and Ana Maria Ltd., who collaborate towards building formalised arguments for change. They see evidence as the key to affecting social change, evidence of suffering, failures, and criminal acts. Moreover, they see the stories of the public and service-providing professionals as evidence. For too long, statistics have told the stories of complex human lives, let that be no more. Qualitative data moves into stories made up of words and images, be that emails, audio recordings, photos or video content. It is hoped that the body of data will one day expand to include NHS and service provider documentation and data, this way, we hope form the entire big picture of complex and failing societal infrastructures, such as the likes of Health and Social Care, and Education.
Journalism Laws and Ethical Standards are in place and secure the safety of any sources/contributors and collaborators. No source’s name will be shared without permission. Once data has been submitted, however, it is automatically redirected towards the case we are building for parliamentary review and potentially one or more High Court Case submissions. All data sent to email addresses affiliated with this site become the intellectual property of The Ana Maria Foundation, Registered UK Charitable Company Number: 133630819, for use in legal matters and pertaining to change on the parliamentary level. Nothing will ever be shared knowingly with the public or news reporting bodies. Names, addresses and contact information will only be shared in the case of legal requirement, for example, in a courtroom context or for submissions of evidence to legal bodies.
At all times, The Foundation and any third parties are obliged to conduct themselves under The Journalist’s Code of Conduct, with regard to this area of the website only.
Source of following information, The National Union of Journalist’s website, (National Union of Journalists (NUJ): Code of conduct).
“The code of conduct has set out the main principles of UK and Irish journalism since 1936. The code is part of the rules of the union. The code’s purpose is to advise members, and other journalists, on how to carry out their work ethically. It has been used by journalists over the decades to challenge unethical instructions and produce content that is “honestly conveyed, accurate and fair”. The code has been democratically agreed by NUJ members. The current code was updated in 2011 and forms part of the union rules as Appendix A.
The Code of Conduct instructs that a journalist:
- At all times upholds and defends the principle of media freedom, the right of freedom of expression and the right of the public to be informed.
- Strives to ensure that information disseminated is honestly conveyed, accurate and fair.
- Does her/his utmost to correct harmful inaccuracies.
- Differentiates between fact and opinion.
- Obtains material by honest, straightforward and open means, with the exception of investigations that are both overwhelmingly in the public interest and which involve evidence that cannot be obtained by straightforward means.
- Does nothing to intrude into anybody’s private life, grief or distress unless justified by overriding consideration of the public interest.
- Protects the identity of sources who supply information in confidence and material gathered in the course of her/his work.
- Resists threats or any other inducements to influence, distort or suppress information and takes no unfair personal advantage of information gained in the course of her/his duties before the information is public knowledge.
- Produces no material likely to lead to hatred or discrimination on the grounds of a person’s age, gender, race, colour, creed, legal status, disability, marital status, or sexual orientation.
- Does not by way of statement, voice or appearance endorse by advertisement any commercial product or service save for the promotion of her/his own work or of the medium by which she/he is employed.
- A journalist shall normally seek the consent of an appropriate adult when interviewing or photographing a child for a story about her/his welfare.
- Avoids plagiarism.”
All website users are hereby made aware that this is not an emergency response service, nor a crisis support service. Neither is it a complaints channel or a service that can show up to advocate for you within any given timeframe. The project outcomes have been made clear throughout the website, but we reiterate them here for clarity:
- To collect national level qualitative data regarding The UK’s more vulnerable demographics.
- To utilise all data collected in a formal collective advocacy role, which may include, but not become limited to: organising collective/class-action law suits; presenting the data to government in a review/summary document.
- CHANGES TO THIS STATEMENT
The Company has the discretion to occasionally update this privacy statement. When we do, we will also revise the “updated” date at the top of this Privacy page. We encourage you to periodically review this privacy statement to stay informed about how we are helping to protect the personal information we collect. Your continued use of the service constitutes your agreement to this privacy statement and any updates.
